Negligence and Cerebral Palsy
What Is Cerebral Palsy?
Cerebral palsy (CP) is not just one disorder. It is a medical term that refers to many different problems that affect a wide range of body functions. Balance, muscle control, nerve function, brain function and head control can be affected by cerebral palsy. In babies and children, symptoms of CP can include delay or the absence of normal development such as rolling, sitting, crawling, walking and more.
Children with cerebral palsy may need lifelong special care.

What Causes Cerebral Palsy?
There are many causes of CP. Most typically, we see cases that concern a lack of oxygen (hypoxia) to the fetus during labor and delivery. Other causes of cerebral palsy and brain damage in fetuses and newborns include infection, poisons, drugs and genetics. The damage is often permanent and lifelong. CP can be the result of negligence on the part of obstetricians, nurses, and other caregivers responsible for the care of laboring mother and child.
Representing Babies and Families Harmed by Doctor Mistakes Since 1979
At the San Francisco Birth Injury Law Office we represent clients whose babies have been injured as a result of the negligent actions of doctors and others. We have the resources to review and evaluate your medical records, and discern whether your baby’s difficulties were caused by carelessness or a breach in the standard of care.
What Negligent Actions Might Cause Cerebral Palsy?
The kinds of negligent actions that may lead to a child having cerebral palsy include:
- Negligent monitoring of the fetal monitor strip
- Drugs such as Pitocin used during labor that increase the intensity and duration of contractions may cause damage
- Delivery was delayed or the c-section was delayed and the baby suffered from a lack of oxygen (hypoxia) or contracted an infection;
- Rh factor incompatibility, causing injury to the baby
- Baby’s jaundice was not cared for properly after birth
Any of these issues can lead to cerebral palsy in a newborn. At the delicate point moment when a baby is being born, any action that interferes with the oxygen flow and the blood flow between baby and mother can cause injury.
